Producing Arrested Suspects in Courts Outside Respective Judicial Zones Violates Constitution – HC Judge Ilancheliyan

While hearing  2002  murder case  in  Kayts  island,  where attack was made  on  TULF   members   causing  death of two ,   the Jaffna High Court Judge , M.  Ilancheliyan  observed,   that  producing AAVA  group suspects  arrested  in Jaffna   in Colombo  High Court  violates Srilanka  Constitution and International Human Rights  and Political Civil Laws.
According to provisions  in Srilanka  Constitution,  any one arrested  on suspicion for offences committed  should be produced in their respective  area courts or nearby courts.  This is not only a requirement  in Srilanka Constitution,   but  a requirement in International Human Rights  and Political Civil Laws too.
During the war period  exception to this was  observe due to situation prevailed then. But now  normalcy has returned in   Srilanka. Hence,  no need to produce  suspects arrested in the North  in the South Courts .
